I believe you've read the material on hit rating. Otherwise you wouldn't be asking this question.
I think the answer is that an item that reduces your hit rating below the hit cap isn't a better item.
In the end the reasoning is that potential damage of 100.000 is worth nothing if you can't hit anything. If the damage you can do is increased but the chance that you hit is decreased you've actually lowered your dps.
For example:
Person A has a chance to hit of 100%. She does 1000 damage. That means that on every attack she does 1000 damage.
Person B has a chance to hit of 50%. He does 1400 damage. That means (on average) that he hits once every two attacks and in the end does 1400 damage per two attacks. Compare this to person A who does 2000 damage per two attacks.
Now, as all gamers know, the dice gods like to mess with us. This means that if you can miss you will miss when it counts the most (hereby christened as Murphy's first law of gaming). If you can't miss, you won't miss. So the dice gods can't mess with you.
Being able to do consistent damage is more important than doing very high damage every now and then and no damage at other times (i think this is also stated in one of the stickies on hit rating).
