It's very possible that you had inadvertently turned to the side or away from the Malicious Instructor, thus nullifying all of your defense skill / talents / skills you had going for you. That would be the only logical reason as to why you were critted.

Simply going by game mechanics, the mob attacking you faster should have absolutely no bearing on whether it can crit you or not. I still stand by my earlier statement -- you were probably slightly turned and as a result, the mob's attack was regarded as a side / back blow instead of a frontal blow. Not trying to blame you or anything, it's just the 95% probable cause for how you are getting crit -- that, and that mob does an AoE that knocks you in the air a little, thus causing the mob to move forward and that probably is what is causing those crits.

Other common ways for warriors to be critted when classes are def capped:
Pressing a 'sit' hotkey, such as x, you may not even make the sit animation, but the game would register it.
Having a teammate Mind Controlled (Think of that nice buff feral druids give, +5% crit chance.)

spells can still crit I think. Also, is it possible for a mob to have it's own expertise rating lowering your change to dodge block parry? I would think that that could make to be crittable.

Mob's spell can not Crit. Dodge/Parry/Block have nothing to do with Crits.
So much confusion with Crits and Crushes in this thread.
Theres only 2 things I can think of. The mob got freakishly lucky, or it had a much higher crit rate than 5%. Considering this wasn't a boss, it would need, what? 10-15% crit rate? That seems doubtful to me.
